Possession of CDS: On June 19, 2019 at 12:44 a.m., Ptl. Sean Higgins was monitoring traffic on Route 23 North. At that time, he observed a 2004 Lexus pass his location with an equipment violation. Ptl. Higgins conducted a traffic stop on the suspect vehicle and contacted the operator and his passenger, later identified as Daniel Garcia, 27 years old of Pompton Lakes, N.J. During his conversation with both occupants, Ptl. Higgins made several observations that led him to believe that a controlled dangerous substance may be in the vehicle. Mr. Garcia was removed from the car and a search was conducted. Mr. Garcia then voluntarily turned over suspected marijuana to Ptl. Higgins. Once under arrest, Ptl. Higgins located several pills on Mr. Garcia’s person that were later identified as suspected Xanax and Alprazolam, which he did not have a prescription for. He was transported to the Pequannock Police Department for processing and was charged with Possession of Under 50 Grams of Marijuana and Possession of a Controlled Dangerous Substance. The driver was charged with Inadequate License Plate Illumination and was released. Mr. Garcia was released with a scheduled appearance at the Morris County Superior Court.
